1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Fig.1 AI, Inc. ("Fig.1," "we," "our," or "us") governing your access to and use of the BOLT Zurkhaneh training platform, including our website, mobile applications (iOS and Android), AI coaching features, and all related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Eligibility

You must be at least 18 years of age to use our Services. By using the Services, you represent and warrant that:

  • You are at least 18 years old
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the Services under applicable law

3. Description of Services

BOLT Zurkhaneh ("BOLT Club") provides an AI-powered training platform for Indian club and Persian meel swing training that includes:

  • Structured video training modules designed by Coach Kenny Johnson
  • AI-powered coaching assistant ("Coach Kenny") for real-time guidance
  • Progress tracking across modules and exercises
  • Equipment recommendations and purchasing through third-party retailers
  • Cross-platform access (web, iOS, Android)

The Services are provided on a freemium basis with a free introductory module and a paid subscription for full access.

4. Account Registration

4.1 Account Creation

To use certain features of our Services, you must create an account using email/password, Google sign-in, or Apple sign-in. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account

4.2 Account Restrictions

You may not:

  • Create multiple accounts to circumvent usage limits or subscription requirements
  • Share your account credentials with others
  • Use another person's account without authorization
  • Create accounts through automated means

5. Subscriptions and Billing

5.1 Free Content

The introductory module is available free of charge and includes club selection guidance, a beginner exercise preview, and an advanced exercise preview.

5.2 Paid Subscription

Full access to all training modules, exercises, and AI coaching requires a paid subscription at $6.99 per month. Subscriptions may be purchased through the web (via Stripe), Apple App Store, or Google Play Store.

5.3 Payment and Billing

  • All fees are in U.S. dollars
  • Subscriptions automatically renew unless cancelled
  • We may change prices with 30 days' notice
  • You are responsible for all applicable taxes
  • App store purchases are subject to the respective app store's refund policies
  • Web purchases through Stripe are non-refundable except as required by law

5.4 Cancellation

You may cancel your subscription at any time. For web subscriptions, cancel through your account settings. For app store subscriptions, cancel through your device's subscription management settings. Cancellation takes effect at the end of the current billing period.

5.5 Cross-Platform Access

An active subscription on any platform (web, iOS, or Android) grants access to the full training library across all platforms when signed in with the same account.

6. Acceptable Use

You agree not to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Services or servers
  • Use the Services to harass, abuse, or harm others
  • Copy, distribute, or publicly display training video content without authorization
  • Reverse engineer, decompile, or disassemble the Services or mobile applications
  • Use automated tools to download or scrape content from the platform
  • Share your subscription access with others
  • Use the AI coaching features to generate harmful, illegal, or inappropriate content

7. Training Content and Safety

7.1 Physical Activity Disclaimer

The training content provided through our Services involves physical activity with weighted equipment (Indian clubs and Persian meels). You acknowledge that participation in these exercises carries inherent risks of physical injury. You should consult with a qualified healthcare professional before beginning any exercise program.

7.2 No Medical Advice

The Services are for fitness and training purposes only and do not constitute medical advice. Coach Kenny AI provides training guidance, not medical recommendations. Always seek the advice of your physician or other qualified health provider with any questions regarding physical activity.

7.3 Assumption of Risk

By using the Services and following any training content, you voluntarily assume all risks of physical injury that may result from your participation in the exercises and training routines.

8. Your Content

8.1 Chat Data

Conversations with Coach Kenny AI are stored to provide continuity and improve your training experience. You retain ownership of the content you provide in chat conversations.

8.2 AI-Generated Content

Coaching advice, training recommendations, and other content generated by Coach Kenny AI is provided "as-is" without warranties of accuracy or completeness. You are responsible for evaluating and appropriately acting on such guidance.

9. Intellectual Property

9.1 Our Property

The Services, including all training videos, exercise content, software, designs, logos, AI models, and the BOLT Zurkhaneh brand, are the proprietary property of Fig.1 AI, Inc. and Coach Kenny Johnson, protected by intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and training content for your personal, non-commercial use in accordance with these Terms.

9.3 Restrictions

You may not:

  • Download, record, or redistribute training videos
  • Use training content for commercial purposes without written permission
  • Remove any copyright or proprietary notices from the Services

10. Data Processing and Privacy

Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.

You acknowledge that your chat conversations and training data may be processed by AI systems, including third-party AI providers (OpenAI), to deliver the coaching features of the Services.

11. Third-Party Services and Equipment

The Services may include links to third-party equipment retailers. Purchases from these retailers are governed by their own terms and policies. We are not responsible for the quality, safety, or delivery of third-party products. Equipment recommendations are provided as guidance only.

12. Service Availability

12.1 Availability

We strive for high availability but do not guarantee uninterrupted access to the Services. We may perform maintenance with reasonable notice.

12.2 Modifications

We may modify, update, or discontinue features, training content, or modules at any time. Material changes will be communicated via email or in-app notification.

13. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Services will be error-free or uninterrupted
  • AI coaching advice will be accurate, complete, or appropriate for your situation
  • Training exercises will be suitable for your fitness level or health condition
  • The Services will meet your specific requirements
  • Any defects or errors will be corrected

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIG.1 AI, INC.'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

IN NO EVENT SHALL FIG.1 AI, INC., COACH KENNY JOHNSON, OR ANY OF THEIR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PHYSICAL INJURY, LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY.

15. Indemnification

You agree to indemnify, defend, and hold harmless Fig.1 AI, Inc., Coach Kenny Johnson, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Services, including any physical injuries sustained during training
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Any content you submit through the Services

16. Termination

16.1 Termination by You

You may terminate your account at any time by cancelling your subscription and requesting account deletion.

16.2 Termination by Us

We may suspend or terminate your account for:

  • Violation of these Terms
  • Non-payment of fees
  • Extended inactivity
  • Legal requirements

16.3 Effect of Termination

Upon termination:

  • Your access to paid content will cease
  • We may delete your data after 30 days
  • You remain liable for any fees incurred
  • Sections of these Terms that should survive will remain in effect

17. Dispute Resolution

17.1 Informal Resolution

We prefer to resolve disputes informally. Please contact us at legal@fig1.ai before initiating formal proceedings.

17.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration under JAMS rules, except where prohibited by law.

17.3 Governing Law

These Terms are governed by California law, without regard to conflict of law principles. Any legal proceedings shall be brought in Los Angeles County, California.

18. General Provisions

18.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Fig.1 AI, Inc. regarding the BOLT Zurkhaneh Services.

18.2 Severability

If any provision is found unenforceable, the remaining provisions shall continue in effect.

18.3 No Waiver

Our failure to enforce any provision is not a waiver of our right to do so later.

18.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

18.5 Force Majeure

Neither party is liable for delays or failures due to circumstances beyond their reasonable control.

19. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance.
